This Monarch Bands website and private Members Area is here to make band life easier — sharing event details, coordinating volunteers, tracking fees, and keeping our community connected. The terms below cover the legal details, but the short version is: be respectful, use this space for its intended purpose (supporting Monarch Bands Boosters), and look out for student privacy. If you have questions about anything here, just reach out to us — we're a small volunteer team trying to do right by our families, not a legal department.  Thank you.

Welcome to the Members Area of monarchbands.org ("the Site"), operated by Monarch Bands Boosters ("MBB," "we," "us," or "our"), a nonprofit booster organization supporting the band programs of Monarch High School. By creating an account or logging in to the Members Area, you ("you" or "Member") agree to these Terms of Use ("Terms"). If you do not agree, please do not register for or use the Members Area.

1. Who May Be a Member

The Members Area is intended for students, parents/guardians of students enrolled in the Monarch High School band program, band staff, and approved volunteers. Accounts are for the personal use of the registered adult member. Student accounts, if offered, are subject to additional parental consent requirements.

2. Your Account

You are responsible for keeping your login credentials confidential and for all activity under your account.
Provide accurate registration information and keep it up to date (especially contact and student information used for rosters, volunteer tracking, and communications).
Notify us promptly at webmaster@monarchbands.org if you suspect unauthorized use of your account.
We may suspend or terminate accounts that are inactive, fraudulent, or in violation of these Terms.

3. Acceptable Use

When using the Members Area (including blog comments, Wix Groups discussions, forms, and volunteer sign-ups), you agree not to:

• Post or share content that is harassing, defamatory, obscene, discriminatory, or otherwise inappropriate, particularly given that some content may be visible to families and students.

• Share another member's personal information (contact details, student information, photos) outside the Members Area without their consent.

• Use the Members Area to solicit business, advertise, or fundraise on behalf of any organization other than MBB without prior written approval.

• Attempt to access areas, accounts, or data you are not authorized to view, or interfere with the security or operation of the Site.

• Upload viruses, malicious code, or content that infringes someone else's intellectual property rights.

We reserve the right to remove content or restrict access for violations of this section, at our reasonable discretion.

 

4. Member-Generated Content

If you post comments, photos, or other content in the Members Area or Wix Groups:

• You retain ownership of your content, but you grant MBB a non-exclusive, royalty-free license to display, reproduce, and distribute it within the Members Area and, where reasonably necessary, in MBB's public communications (e.g., a newsletter recap), unless you mark it as private or request otherwise.

• You are responsible for ensuring you have the right to post the content (e.g., permission to share photos of other people's children).

• Photos of students may only be posted in a manner consistent with MBB's and BVSD's student privacy expectations. Do not tag or publicly identify students without parental consent.

5. Fees, Payments, and Volunteer Commitments

Certain features (ensemble fees, ticketed events, fundraising items) involve payment through our designated payment processor. All purchases are subject to the pricing, refund, and deadline terms stated at the time of purchase.

Volunteer sign-ups (including shift-based and standing positions) reflect a good-faith commitment to the organization. While not a legal contract, repeated no-shows may affect your ability to sign up for future opportunities.

MBB is a volunteer-run nonprofit; we do our best to keep payment and scheduling information accurate but are not liable for incidental errors (e.g., a sync delay between systems). Please contact us promptly if you notice a billing discrepancy so we can correct it.

6. Privacy

Our use of your personal information is governed by our Privacy Policy. By using the Members Area, you consent to that policy, including the use of your information for band communications, volunteer coordination, and fee processing.

 

7. No Warranty

The Members Area is provided "as is." MBB makes reasonable efforts to keep the Site accurate, secure, and available, but we do not guarantee uninterrupted access, error-free operation, or that information (such as calendars, rosters, or volunteer data) will always be current. 8. Limitation of Liability

To the fullest extent permitted by law, MBB, its board members, officers, and volunteers are not liable for any indirect, incidental, or consequential damages arising from your use of the Members Area, including reliance on information posted there. This does not limit any liability that cannot be excluded under applicable law.

 

9. Indemnification

You agree to hold MBB and its volunteers harmless from claims arising out of your misuse of the Members Area or violation of these Terms, except where such claims result from MBB's own negligence or willful misconduct.

 

10. Changes to These Terms

We may update these Terms from time to time to reflect changes in our systems or practices. Continued use of the Members Area after an update constitutes acceptance of the revised Terms. Material changes will be noted on this page with an updated "Last updated" date.

 

11. Termination

We may suspend or terminate your access to the Members Area at any time for violation of these Terms or for any reason consistent with protecting the organization, its members, and students.

 

12. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles.
